Today I reported the restuarant to the Food Safety Dept.
They have now told us they will be asking a third party to come in on this.
All they seem to care about is the money.
I am pretty devastated and just cannot wait until Mark is home and can deal with this.
(Bit scared that he goes round there, all 6'3 of him)
My Dad said they may sue me!

I've just picked up on this and I'm absolutely horrified!!! How could they even think about suing YOU!!! Most decent places would be only too pleased to resolve it properly.
I hope you get it all sorted out asap. I'm sorry to hear that your night out was ruined. Thankfully it was found in time.

I wouldn't worry about it Amamnda. If you have reported them they won't have a leg to stand on. Do you still have the nail?

They wouldn't dare sue you Amanda! If it went to Court you'd have the ideal platform, in the witness box, to explain all about the nail in your lad's food and their terrible customer service! It would all be reported in the local papers, maybe even National Press! Do you think they would honestly risk that sort of publicity! They're just talking crap! In fact, I would welcome the opportunity to go to Court! Stewart. A friend is someone who knows all about you but loves you anyway!

If that's the case then they should also have you on camera fishing the nail out of his food! I take it you've kept the nail with the food on it and put it into a plastic bag. Give it to the Food Standards people. To be fair, some restaurants get hit quite hard with people having big meals and after eating producing all manner of things and saying they've found it in the food and then refusing to pay! I would think the manager has just misread the situation. Don't worry. What is the chap asking you to do? Is he asking for you to pay for the meals or part of the meals or what? A friend is someone who knows all about you but loves you anyway!

Sounds like they are trying to intimidate you Amanda. What are they suggesting, that you made off without payment, under the Theft Act? Have they forgotten the extenuating circumstances? Carol

No, what happened was we were uncertain what to do so we said we *may* pay them for half the meal.
Then after I phoned my brother who is a barrister for some advice/help, he said to refuse to pay and leave asap. He did say to photograph the screw but I didn't. So now they are disputing the fact that although we had (almost) agreed to pay half we then changed our minds and said we wouldn't. They do not deny the screw was found in the cheesecake and was their fault. (Although they were trying to portion blame upon the manufacturers of the mixer etc and reported it to the police for insurance purposes!).
I think the manager has no idea how to behave towards clients and is (possibly) not too intelligent or knowledgable with regards to customer care and public relations as if he believes this will no cause him negative publicity.....
He should not be swabbling over £60 that is for sure!

He can blame who he wants....but as he's selling the stuff it's all down to him and his restaurant! It's a shame you haven't got the offending article but what you have got is all the posts you've stuck up on the forum in date and time order! If it comes to it, remember to print off the whole sequence. Honestly, Amanda, I wouldn't worry......and if you've got a barrister on the team then a polite letter from his firm to the restaurant, if needed, should up the ante!! Please don't worry the restaurant owner is talking a load of tosh and trying to intimidate you, and this is SO not on. The reason why the manager is behaving this way, as you rightly suggest, is because he's cerebrally challenged. I would speak with your brother again and believe that a nicely worded letter from a legal body will put the collywobbles on him.
After finding the nail, you were within your legal right to leave a restaurant without paying. I did exactly that after finding a cockroach in my plate of soup at a Chinese restaurant, and my friend and I refused to pay. The owner tried to prevent us from leaving the restaurant by grabbing onto my arm, ME in my loud voice told all the patrons what I had just found in my soup and recommended that they stop eating. He soon let me go and I duly reported him to environmental health and the restaurant was shut down.
